Police and Fire Disability
Anthony G. Argeros, L.L.C. is proud to be one of the premier law firms for police and fire disability cases in Illinois. We appreciate everything these men and women do to protect our communities and are honored to serve them whenever we can, however we can.
Landmark rulings and noteworthy cases
Mr. Argeros has handled multiple cases that have shaped the course of first responders' benefits law in Illinois.
One such example is Bahr v. Bartlett Fire Protection Dist., where Steven G. Bahr sought benefits under the Public Safety Employee Benefits Act and the Public Employee Disability Act, and the circuit court granted his employer partial summary judgment and dismissed all remaining claims. Mr. Argeros appealed and Mr. Bahr received insurance benefits under the PSEBA, as well as a year and a half of full pay under the PEDA statute. This was the first Illinois decision finding that all of the employee's attorney's fees incurred to recover PEDA benefits should be paid by the employer.

In Phalin v. McHenry County Sheriff's Dept., Mr. Argeros represented a corrections officer in a suit against the McHenry County sheriff’s department after the officer suffered a catastrophic injury during an altercation with jail inmates and became unable to perform his duties as a corrections officer. The plaintiff sought health insurance coverage under the PSEBA and an award of attorney fees under the Attorneys Fees in Wage Actions Act and, though the court initially awarded judgment to the sheriff’s department, Mr. Argeros appealed the ruling and was able to reverse the court's original decision. This was the first Illinois decision finding that all of the employee's attorney's fees incurred to recover PSEBA benefits should be paid by the employer.

Most recently, Mr. Argeros prevailed in Gary A. Devaney v. The Board of Trustees of the Calumet City Police Pension Fund, et. al, where Mr. Devaney was unfairly denied his duty disability pension after suffering a severe injury in the line of duty as a police officer. Mr. Argeros appealed this decision, and Mr. Devaney was ultimately able to obtain his duty disability pension and full benefits.
